Buying a new home involves several steps that need to be completed so that we can enjoy it as soon as possible with complete peace of mind. And one of the final steps that new homeowners typically complete is registering the property with the land registry. What does the property registration process for a new home involve?

The Land Registry is a public institution that allows citizens to formally register their real estate. Through this process, a record is created of the owner, the property’s characteristics, and the rights associated with it, such as a mortgage or a lien.

Specifically, the owner may “register or record acts, contracts, and judicial or administrative decisions that affect ownership and other rights in real property, as well as certain judicial decisions that affect the legal capacity of individuals.” In fact, registrations are organized by property, since a separate registry folio is opened for each one to record its legal history.

Land Registries fall under the jurisdiction of the Ministry of Justice, and all matters pertaining to them are handled by the General Directorate of Registries and Notaries. In addition, each registry is headed by a registrar and covers a specific territorial jurisdiction.

Are we required to register our new home with this agency?

No, it is not a mandatory requirement. The law gives us the freedom to make this decision ourselves, but it is important to know that completing this registration will provide us with numerous benefits. Among them:

  • Legal recognition of our ownership: thanks to this, we can be certain that we are listed as the owners of the home.
  • Legal certainty: Completing this registration provides us with legal guarantees, because both our ownership and our rights as property owners are protected by the courts.
  • Ease of transferring property ownership in the Cadastre: When you complete this process, the home will also be registered in the Cadastre. This means that the Property Tax (IBI) will now be in the new owner’s name.
  • Eligibility for a mortgage: To approve a mortgage to help finance the property, banks require proof that the property is registered in the Property Registry.
  • Recording of encumbrances: When a property is properly registered, its encumbrances, debts, and outstanding payments are recorded. This is particularly useful for buyers, as it allows them to know—even before finalizing the purchase—whether they will have to assume any extraordinary costs once the property is in their name.

Therefore, if we do not complete this process, we’ll be exposed to undesirable situations. For example, if our home previously had another owner who did register it in their name, they could sell it to a third party in the future as if they were still the owner (with the consequent risk for us of losing it). Or we might even face foreclosure because the property is registered in the name of someone with outstanding debts; this would force us to endure lengthy and costly legal battles to prove that we are the rightful owners.

How can we file our application for property registration?

We have three ways to handle this paperwork:

  • In person at the registry office in the area (province) where the property we are going to register in our name is located.
  • By mail.
  • By fax, in order to prevent any type of fraud.

Documents Required to Register a Home with the Land Registry

Please note that, in order to complete this process properly, you must first have three different documents on hand:

  • A notarized copy of the public deed of sale for the property.
  • The self-assessment form substantiating payment of the Property Transfer Tax.
  • The justification for proof that all documentation has been submitted to complete payment of the municipal capital gains tax ( this can be provided by the seller).

After submitting these documents, either in person or online, the registration will be officially finalized within approximately 15 business days. Provided, of course, that all the paperwork complies with the regulations. If it does not, the registrar will notify the applicant of the problem so that the applicant can correct it or, if the applicant disagrees, request a review of the decision in accordance with the procedures established by law.

How much does it cost to register a property?

The cost of the procedure depends on three factors:

  • The value of the property as stated in the deed
  • The location of this
  • Its features.

The result of all this is what is known as the registry value. Specifically, the average registry fee ranges from 600 to 1,000 euros, never falling below 24.04 euros or exceeding 2,181.67 euros.

Price of the house

To give you an idea and help you calculate the price that would apply in your case, here are the rates:

  • If the property is valued at no more than 6,010.12 euros, the fee will be 24.04 euros.
  • If the value falls between 6,010.13 euros and 30,050.671 euros, the cost will be the initial 24.04 euros plus an additional 1.75 euros for every 1 , 000 euros of value above that amount.
  • Between 30,050.62 and 60,101.21 euros, there will be an additional 1.25 euros for every additional 1 , 000 euros.
  • For amounts ranging from 60,101.22 to 150,253.03 euros, an additional 0.75 euros will be paid for every 1 , 000 euros.
  • For amounts between 150,253.04 and 601,012.10 euros, an additional 0.30 euros must be paid for every 1,000 euros.
  • If the total value of the home exceeds 601,012.10 euros, the payment will be an additional 0.20 euros for every 1 , 000 euros.
