In addition to being an essential room in every home, the bathroom is also a space that should reflect the homeowner’s personal taste. Since it serves basic functions related to personal hygiene and well-being, it must meet the needs of each individual or family; as a result, along with the kitchen, it is one of the most frequently remodeled rooms.

The truth is that there are many reasons to undertake renovations in a home. For example, in the case of new homes, renovations may be done for aesthetic reasons or to make necessary adaptations so that the home can be used by seniors or people with limited mobility. Meanwhile, for existing homes, there may be another compelling reason: renovating the bathroom fixtures or plumbing to ensure optimal maintenance.

In any case, whatever your needs may be, many people who decide to take this step aren’t sure whether they need a building permit to renovate their bathroom. That’s why, in this article, we’re going to answer this important question and explain how you can apply for one—if you end up needing it.

Bathroom Renovation

Do I need to apply for a building permit to renovate a bathroom?

The short answer is yes. Each municipality has its own regulations, but we recommend that you visit your local city hall to find out about the specifics of your situation and the requirements you must meet.

Keep in mind that a building permit or building permit is an administrative authorization granted by a public authority—such as a city council—to carry out construction or remodeling work. Therefore, it is a document that certifies that the project complies with the law and is carried out in accordance with the minimum requirements regarding safety, health, the environment, and urban planning.

Therefore, based on this, any person, company, or organization planning to carry out construction work on an existing building or wishing to construct a new one must specifically apply for a building permit, regardless of the size or scope of the project.

Do I also need to request a building permit from the homeowners’ association to renovate the bathroom?

No, it is not mandatory to ask the homeowners’ association for permission to carry out the renovation, since the building permit issued by the city council will be more than sufficient. However, it is advisable to inform both the president of the homeowners’ association and the neighbors closest to your home about these plans, to let them know about any potential inconvenience they might cause and how long the work will take.

If you don’t, you may face a complaint regarding the disturbances caused by the construction work, such as noise or debris.

What type of building permit is required for a bathroom renovation?

In Spain, a distinction must be made between two main types of construction projects:

  • Major construction work, consisting of a modification or expansion of the property’s floor area. It involves structural changes to the building or changes in the use of its spaces, and is therefore necessary when a comprehensive renovation of the home is planned.
  • Minor construction work, in which the renovation does not involve significant changes or alterations to the floor areas. In these cases, neither the building’s structure nor the common areas are affected.

Each type of construction project requires a specific permit to proceed, although in some cases—depending on the municipality— it isn’t even necessary to apply for this permit, since the modification is very simple and minor. For example, since 2020 in the Community of Madrid, minor construction projects—such as painting, tiling, or electrical system upgrades—do not require a permit.

This is why it’s essential to find out what the local ordinances in your municipality stipulate. However, as a general rule, you can rest assured that a building permit for a bathroom renovation is usually classified as a minor project, since the renovation typically involves only aspects such as the floor, walls, bathroom fixtures, plumbing, or electrical work. In other words, it does not involve a complete renovation of the home or a structural change to the building.

Construction on a New Home

What are the steps involved in obtaining a building permit to renovate a bathroom?

As we have indicated, you should contact your city council—or a representative you designate, such as the person in charge of the construction project—and, more specifically, its urban planning department. You can do this in person or online, if your city council offers this option. This department will provide you with a prior notification form, depending on the type of permit you wish to apply for. In this case, a minor construction permit.

After filling out the information requested on the form mentioned above, you must attach the required documentation. This usually consists of:

  • A photocopy of the ID card of the owner of the property where the bathroom renovation work will be carried out.
  • Building plans and technical specifications for the renovation project. For minor renovations, this will not be required, although the details of the renovation must be provided.
  • Construction Budget.
  • Materials to be used in this renovation.
  • Signature of the contractor or the technician responsible for the project.
  • A document certifying that the fees for the urban development projects to be carried out have been paid.

After receiving all this documentation, the city hall’s administrative staff will verify it and begin the application process. As part of this process, a specialized technician will verify the documents and confirm their validity; if any information is missing or there are any issues, the applicant will be asked to resolve them within a maximum of 10 days.

Thus, once the documentation has been approved, the permit will be issued and delivered to the applicant along with a form for paying the ICIO tax (Tax on Construction, Installations, and Works). This includes:

  • The taxable base (actual cost of the project),
  • The tax rate (as specified by each city council’s ordinance, which may not exceed 4%) and
  • The tax amount, which is calculated by applying the tax base to the tax rate.

Does the building permit for renovating the bathroom have an expiration date?

Yes, so try to apply for it not too long before you start renovating the bathroom in your new home. In fact, its validity period depends on the complexity of the work to be done, which is determined by the municipal technicians responsible for processing the application.

What could happen if I don’t apply for a building permit and go ahead with the construction anyway?

If your local city council is aware that you are carrying out renovation work in your bathroom without the required permit, it may initiate disciplinary proceedings. This will result in the work being halted until you obtain the permit and pay the fine that has been imposed.

Building permit to renovate the bathroom

Contact your local city hall to obtain the building permit you need

According to the “2021 Report on the Home Renovation Sector in Spain”, one in three partial renovations (33%) carried out in the country involves the bathroom. Therefore, applying for a building permit to renovate a bathroom is a very common procedure and, generally speaking, a very straightforward one as well.

Despite this, it’s important to take this seriously and notify the city council of the construction work you plan to carry out. The city council, in accordance with its ordinances, will then be responsible for determining the requirements that must be met: obtaining a permit, paying fees for, for example, debris removal, temporary occupation of public streets, paying a tax, etc.

So now you know: if you’re not sure, do your research and provide your local government with all the information it requests. That’s the only way to make sure you have the building permit you need to renovate your bathroom!
