Title Deed Ceremony

  • The deed of sale of a property consists of the execution of the public deed of sale before a notary public, act by which the seller delivers the possession and full ownership of the property to the buyer, who acquires it and is given the keys. The buyer, on the other hand, pays in this act the part of the purchase price that remains to be paid. The deed of sale makes it possible to register the property in the name of the buyer in the Land Registry, with the legal certainty that this brings to the acquisition. Likewise, after the execution of the deed of sale and in the same act, the buyer is given a welcome packet with the documentation of the property, including the legally required documentation (plans, specifications, technical documentation, etc.).

  • Depending on the autonomous legislation, but, in principle, we can confirm that it is possible to register the deed when the deed of horizontal division has been registered, the house has been built and the “Acta de Fin de Obra” has been signed before a notary, as well as its presentation in the property registry, and the first occupancy license and/or certificate of occupancy has been obtained, in addition to obtaining the necessary installation bulletins to register the utilities.

  • At least 10 days (15 days in Catalonia) before the date set for the signing of the deed of sale, the Bank must contact the client to sign the corresponding FEIN, and upload it to the notarial platform together with all the documentation relating to the signing of the Act of Transparency. The purpose is to guarantee that they know, understand and have been duly informed of the conditions of the loan, and that the bank conditions they have been offered correspond to those stated in the deed.

    Once 10 days (or 15 in Catalonia) have elapsed since the bank uploads to the notarial platform the documentation required for the signing of the Deed of Transparency, and once signed, the deed of sale and mortgage loan of the property may be granted at the time and day agreed with CULMIA.
