Delivery
The manual of use and maintenance of the dwelling is the document that includes the description of the main elements and installations of the dwelling, and in which the guidelines that the user and/or owner must take into account in order to properly use and maintain the dwelling in good condition are indicated. It will also include a list of the materials used and the suppliers involved in the execution of the work.
In this way, the property or premises to be delivered will form part of a community of owners already in operation, after the developer has carried out all the necessary procedures for its start-up (contracting of services and supplies for common areas, such as electricity, water, maintenance, cleaning, insurance, administrator, etc.). However, the different co-owners may make any modifications they deem necessary or replace the contracts they deem appropriate.
The guarantees applicable to housing are defined in Law 38/1999, on Building Regulation (L.O.E.), and as of today are as follows:
- ONE YEAR for vices or defects of execution that could affect finishing elements or finishes (art. 17.1).
- THREE YEARS for possible vices or defects of the constructive elements or of the installations that could cause the non-compliance of the habitability requirements (art. 17.1.b).
- TEN YEARS for possible faults or defects affecting the foundations, supports, beams, slabs, load-bearing walls or other structural elements that directly compromise the mechanical resistance and stability of the building (art. 17.1.a).
The terms for the application of these guarantees are as of the date of the construction acceptance of the development.
On the other hand, the household appliances installed in the home are covered by the warranties given by the manufacturers of the equipment, as specified in their instructions for use. In the event of a breakdown, the buyer should contact the technical service of the corresponding brand. Currently, the warranty period is 2 years. This period begins when the equipment is commissioned by the manufacturer’s technical assistance service. If the equipment is not commissioned by the manufacturer’s technical assistance service, the date of the deed to the property will be taken into account.
- Damage to individual or common equipment and installations due to non-compliance with maintenance checks.
- The effects caused on the installations by unauthorized personnel, for this reason, we advise to contract the maintenance of the installations to the installers themselves.
- Water damage caused by clogged rainwater drains, manholes or sewage pipes due to improper use or lack of maintenance.
- The breakage of false plaster ceilings, glass, sanitary porcelain and pieces of flooring or tiling, by blows or by the careless execution of drilling to place supports, lamps or hangings.
It is the document that formalizes the act by which the Builder, once the work is completed, delivers it to the Developer.
